FICTITIOUS BUSINESS NAME (FBN) STATEMENT:
Prior to opening a business, a business name must be selected that is not already in use and then registered. A fictious business name must be registered and it is generally required to be published in an authorized local newspaper. The theory is that this publishing will notify the local community that your business is now transacting under the specified name. The publishing also relates you, an individual or corporation with a specific name of a business.
It is important that you check to make sure that your selected DBA name is available for use and not previously registered.
Under what situation is a DBA not required?
A dba may not be required if you are operating your business under a registered name with the Secretary of State office, or if you are operating your business under your legal name.
This is not the case in all jurisdictions so you must check with your local office to make sure you comply with local business laws.
